Emojis are everywhere now. But use them with caution as increasingly, Courts are ruling on the legal aspects of it. You may get into / out of a Contract or get into trouble without even intending the same !
Here a recent Canadian case:
A grain buyer in Saskatchewan, Canada, texted farmers asking to buy flax at $17 per bushel, and one farmer indicated he could deliver on that. The buyer texted a photo of the contract, as it had done numerous times before, and asked, “Please confirm flax contract.” The farmer replied with a thumbs-up 👍 emoji. The farmer failed to deliver ( Actually the price went up and of course it was more lucrative for the farmer to get out !). The Buyer sued for breach. The farmer argued he was simply agreeing he would review the contract at a later date.
The Judge ruled that the farmer’s 👍 counted as a signature and the farmer had thus breached the contract:
” This court readily acknowledges that a 👍 emoji is a non-traditional means to “sign” a document but nevertheless under these circumstances this was a valid way to convey the two purposes of a “signature” – to identify the signator (Chris using his unique cell phone number) and as I have found above – to convey Achter’s acceptance of the flax contract.”
The farmer was ordered to pay more than $61,400 in damages to the buyer !

In a 2017 case in New Zealand, the Judge held that a Text Message followed by an Emoji was threatening ( which was agreed by the Defense counsel as well ). The message was :

In 2016, a French Court sentenced a man to a three months prison and fine of Euros 1000 in a case that also hung around use of emojis.
In this case, the man sent a message with a pistol ” emoji” in the summer of 2015 to a girl who was a minor at the time. This was one of the many text messages with which he flooded his unnamed ex-girlfriend after the pair split up.
The fact of the matter is that indeed most of us are using emojis as ” short form communication” for various purposes – to disagree ( 👎 ), agree (👍 ) , love and romance ( ❤️). Generally there are no legalities expected. But Law can catch up – and is catching up- fast. So be aware !

इमोजी अब बहुत इस्तेमाल होते हैं। लेकिन उन्हें सतर्कता से उपयोग करें ! कई कोर्ट्स ने अब इसके कानूनी पहलू पर फैसले देना शुरू कर दिया है। आप अनजाने या बिना इच्छा के ही एक समझौते / कॉन्ट्रैक्ट में जा सकते हैं या उस से निकाले जा सकते हैं , या किसी मुसीबत में फंस सकते हैं!
हाल ही में कनाडा में यह मामला हुआ :
कनाडा के सस्काचेवन में एक अनाज खरीदार ने एक किसान को 17 डॉलर प्रति बुशेल में अनाज खरीदने की पेशकश की थी। खरीदार ने पहले की तरह इस कॉन्ट्रैक्ट को भी अनुबंध की एक तस्वीर के साथ टेक्स्ट कर दिया और पूछा, “कृपया पुष्टि करें।” किसान ने एक थंब अप 👍 इमोजी के साथ जवाब दिया। लेकिन जब अनाज़ की कीमत बढ़ गयी तो किसान मुकर गया यह कहते हुए की वह सिर्फ इस बात को मान रहा है की कॉन्ट्रैक्ट को बाद में और पढ़ेगा।
न्यायाधीश ने फैसला दिया कि किसान के 👍 को एक हस्ताक्षर के रूप में माना जाएगा और इस प्रकार किसान ने कॉन्ट्रैक्ट का उल्लंघन किया था।
“यह न्यायालय स्पष्टतः स्वीकार करता है कि 👍 इमोजी एक गैर पारंपरिक तरीका है एक दस्तावेज़ को “साइन” करने के लिए, लेकिन इन परिस्थतियों के तहत इस अवस्था में यह एक मान्य तरीका था….”
किसान को खरीदार को $61,400 देने के आदेश दिए गए थे!

2017 में न्यूजीलैंड में एक मामले में न्यायाधीश ने एक टेक्स्ट संदेश और उसके साथ जुडी इमोजी के बाद धमकी के रूप में माना था (डिफेंस वकील ने भी यह बात मानी थी )। संदेश यह था:
भेजने वाले व्यक्ति को आठ महीनों के लिए जेल सजा दी गई थी।

2016 में, एक फ्रांसीसी न्यायालय ने एक आदमी को एक तीन महीने की कैद और 1000 यूरो की जुर्माना डाला था। यह केस भी इमोजी के उपयोग के ऊपर है ।
इस मामले में, इस आदमी ने 2015 में अपनी एक्स-गर्लफ्रेंड को एक पिस्टल “इमोजी” के साथ एक संदेश भेजा था।
न्यायाधीश ने फैसला दिया कि यह इमोजी एक धमकी को व्यक्त करने के रूप में माना जाएगा, और इसलिए इस आदमी को दंडित किया जाना चाहिए।

इन मामलों से स्पष्ट होता है कि इमोजी का उपयोग करते समय सावधानी बरतना बहुत जरूरी है। हालाँकि अधिकतर मुद्दों में अधिकांश लोगों के लिए इमोजी का उपयोग समस्या का मुद्दा नहीं होता है। लेकिन अगर कोई लीगल / कानून प्रक्रिया आगे हो सकती है तो इमोजी सोच कर इस्तेमाल करें !
