A screenshot merely shows what appears on a screen at a particular moment. It does not automatically establish:

  • Who created the message
  • Whether the content was altered
  • Whether the source device was genuine
  • Whether the data remained intact

Courts are concerned not only with the content of a digital record but also with its authenticity and reliability.

Electronic evidence in India is governed by the Bharatiya Sakshya Adhiniyam, 2023, which replaced the Indian Evidence Act, 1872. Section 63 of the Bhartiya Sakshya Adhinyam ( earlier S. 65 of the Indian Evidence Act ) may be referred to for details. An appropriate certificate is required to be prepared and attached with the digital evidence(s).

The provisions dealing with electronic records continue the principle that digital evidence must satisfy statutory requirements before being relied upon in court.

The law recognizes that electronic records occupy a special category because they can be duplicated infinitely without affecting the original. Therefore, additional safeguards are necessary to ensure trustworthiness.

Anvar P.V. v. P.K. Basheer

This judgment fundamentally changed the treatment of electronic evidence in India. The Supreme Court emphasized that compliance with statutory requirements relating to electronic records is essential when electronic evidence is produced before a court.

Arjun Panditrao Khotkar v. Kailash Kushanrao Gorantyal

A three-judge bench of the Supreme Court reaffirmed the principles laid down in Anvar P.V. The Court clarified important aspects regarding the production and admissibility of electronic records and the circumstances in which statutory certification requirements apply.

These decisions continue to serve as leading authorities on electronic evidence.

If electronic evidence may become relevant in a dispute:

  1. Preserve original devices whenever possible.
  2. Avoid deleting chats, emails, or recordings.
  3. Maintain backup copies.
  4. Preserve metadata where available.
  5. Seek legal advice before filing or producing electronic records in court.

Early preservation is often more important than collecting evidence later.

Digital evidence plays a crucial role in modern litigation. However, a WhatsApp chat, screenshot, or email does not automatically become admissible evidence merely because it exists.

Courts examine authenticity, reliability, source, and compliance with legal requirements before relying on electronic records. Understanding these principles can help individuals protect their rights and avoid costly mistakes during legal proceedings.
